KARNATAKA HIGH COURT ADMITS BANKS’ PLEA TO WIND UP KINGFISHER AIRLINES


Bangalore, Dec. 6:  
The Karnataka High Court on Friday admitted a petition filed by a consortium of 14 banks, led by State Bank of India (SBI), seeking winding up of the grounded Kingfisher Airlines Ltd (KAL). 
 
The Court, however, postponed the process of issuance of public notice about the winding up process, while adjourning further hearing to the second week of January. It will then hear the arguments of the banks as well as the company on issuing public notice as per the provisions of the Companies Act, 1956. 
 
Justice Anand Byrareddy passed the order after Vijay Mallya-led Kingfisher Airlines was unable to demonstrate any concrete progress in reviving the company. 

Kingfisher in September had indicated to the Court that it was working out a scheme for revival. 
 
During the hearing, Senior Counsel K.G. Raghavan, appearing for Kingfisher, submitted a copy of the e-mail sent to SBI, intimating the lender about the steps taken to revive the company and that certain foreign firms are engaged in due diligence of the records of the airline. 
 
He also submitted that the company has now directly engaged the largest creditors in its process of reviving. 
 
However, Senior Counsel S.S. Naganand, appearing for the banks, said no detail of the revival process had been mentioned in the communication and the company could have engaged the banks in the revival process about a month ago.

SBI ASKS OFFICERS TO MEET LOAN-SEEKERS ONLY AT BRANCH


Mumbai, Dec. 5:  
To ensure that the dealings of its officers are more transparent, State Bank of India has asked them not to meet the borrowers, existing as well as prospective, at any location other than the branch. 
 
According to instructions given to field-level functionaries, an officer should hold meetings with the borrower only in the presence of other officers. 

One-on-one meetings and meetings at the residence of either the officer or the borrower should be avoided. 
 
Further, talks between the bank staff and the borrower, who may come for a loan/enhancement of loan limit/ one-time compromise settlement of a loan that has gone sour, should ideally be video recorded. 

The emphasis on transparency in officers’ dealings with borrowers comes in the wake of the Central Bureau of Investigation recently registering a case against SBI Deputy Managing Director Shyamal Acharya, Chairman of a New Delhi-based private company and others in an alleged bribery case. 
 
Visitors register

To minimise transgression in the sanction of loans, all branches/offices will have a visitors register, which would contain a trail of visitors meeting bank officials. 


Packets brought in by customers will be scrutinised at the reception, said a senior bank official having knowledge of the new transparency regime being ushered in. 
 
Apparently, the management of India’s largest bank wants to ensure that its loan sanction procedures are not undermined and loans are granted solely on the basis of merit of the proposals. 
 
Last week, SBI constituted an internal committee comprising two senior Managing Directors — Hemant Contractor and A. Krishna Kumar — to investigate allegations of wrongdoing against its Deputy Managing Director. 
 
The DMD has been asked to proceed on leave, a bank spokesperson said. 
 
The bank constituted the committee following the CBI registering a case against its official for alleged graft in sanctioning a Rs 75-crore loan to a New Delhi-based private company.

AIBEA LISTS OUT TOP 50 BAD LOAN ACCOUNTS - TOP DEFAULTER IS KINGFISHER :



Kingfisher Airlines tops a list of 50 top loan defaulters drawn up by public sector banks. 

The list, released by the All-India Bank Employees Association, says Vijay Mallya’s now-defunct airline owed Rs 2,673 crore to public sector banks. 

The list was released by the trade union ahead of its December 5 ‘All-India Demands Day’ against what it calls the corporate loot of public money and to press for stringent measures to recover bad loans from corporate borrowers. 
 
According to the union, Winsome Diamond and Jewellery Company, with dues of Rs 2,660 crore, is the second highest defaulter, followed by Electrotherm India Ltd at Rs 2,211 crore. 
 
Some of the other big-ticket defaulters are: 

Zoom Developers (Rs 1,810 crore), 

Sterling BioTech (Rs 1,732 crore), 

S. Kumars Nationwide (Rs 1,692 crore), 

Surya Vinayak Industries (Rs 1,446 crore), 

Corporate Ispat Alloys (Rs 1,360 crore), 

Forever Precious Jewellery and Diamonds (Rs 1,254 crore), and 

Sterling Oil Resources (Rs 1,197 crore). 
 
The union, in a statement, pointed out that bad loans in public sector banks had crossed Rs 1,64,000 crore. 

“In the name of reforms and liberalisation, banking regulations are being de-regulated; one of the adverse effects of this is the increase in bad loans in the banks where big borrowers take loans (which) they do not repay,” the union said. 
 
Kick out bad loans before they kill the banks’ is the slogan the union will highlight during the December 5 demands-day observance.

While the constituent Unions have submitted the Joint Charter of Demands on 30.10.2012 to IBA, IBA assured to settle the issue of wage revision at the earliest and even the date of concluding the wage settlement was set on 14.08.2013.

The attitudes of the IBA, Government of India and Reserve Bank of India are clearly against the interest of Bank workforce, interest of the Nation and above all interest of depositors, who have invested hard earned savings in the Public Sector Banks.

Inspite of “Standing Committee of Finance” have opposed the proposal of granting new licences to corporates, RBI is bent upon going ahead with the exercise.  Public  Sector Banks have stood the test of the times under the Regulatory regime and they are the nation buildings instruments.  These  Institution are to be protected, preserved and also promoted.

Hence, we call upon the affiliates and State Committees to implement the programmes with utmost seriousness, so as, the authorities to feel the heat of the agitation in full measure.

Dear Sir,

You are well aware that the previous wage settlement has expired on 31-10-2012 and hence a revised settlement has become due from 1-11-2012.  In order to negotiate  the revised wages and service conditions of bank employees and officers, all the Unions under the banner of United Forum of Bank Unions have submitted their common charter of demands in October, 2013.  Even the formal negotiations were started in February, 2013, so far only 5 rounds of discussions have taken place and further, IBA has not so far come out with their offer on the demands raised by the Unions.

It will be appreciated that the alarming and unabated price rise have seriously eroded the income of the employees and hence the wage revision has become all the more important.  The Consumer Price Index has gone up by almost 2400 points under (1960=100) Index series since November, 2007.  Hence wage revision to catch up with the high inflation and price rise has become an urgent necessity.
Similarly, the workload in the bank branches has gone up substantially due to increase in total volume of business and also due to non-provision of adequate staff and officers in the branches.  Employees and officers are working under a lot of stress and strain.  The job profile of the staff has also undergone a change and all these require to be properly remunerated with adequate increase in wages.  For this reason also the wage increase has become important.

But unfortunately, the IBA is delaying the Settlement and during the last one year, not even their minimum offer has been indicated to the Unions. 

In view of the delay and the casual approach of the IBA, it has become necessary to express our protest over the delay and to demand wage revision settlement.

Accordingly, at the call of United Forum of Bank unions, all the employees and officers in the Banks will be observing a day’s protest strike on 18th December, 2013.

While endorsing the strike call, we demand of the IBA to expedite the negotiations in a time-bound manner and conclude the settlement immediately.

Interest Subvention Scheme
As directed by the Government of India and in pursuance of the budget announcement made by the Finance Minister relating to the Interest Subvention Scheme 2013-14, Interest subvention of 2 % p.a. will be made available to Public Sector Banks (PSBs) and Private Sector Scheduled Commercial Banks (in respect of loans given by their rural and semi-urban branches) on their own funds used for short-term crop loans up to Rs.3,00,000/- per farmer provided the lending institutions make available short term credit at the ground level at 7% per annum to farmers. This amount of interest subvention will be calculated on the crop loan amount from the date of its disbursement/drawal up to the date of actual repayment of the crop loan by the farmer or up to the due date of the loan fixed by the banks whichever is earlier, subject to a maximum period of one year.
2. Besides, additional interest subvention @3% will be available to the prompt paying farmers from the date of disbursement of the crop loan up to the actual date of repayment by farmers or up to the due date fixed by bank for repayment of crop loan, whichever is earlier, subject to a maximum period of one year from the date of disbursement. This also implies that the prompt paying farmers would get short term crop loans @4% per annum during the year 2013-14. This benefit would not accrue to those farmers who repay after one year of availing such loans.
3. Further, in respect of KCC Scheme, the GoI has clarified that loans granted only for categories at S.No. (i) and (ii) out of the following six categories are covered under the Interest Subvention Scheme, which should be computed and segregated accordingly for claiming interest subvention :
  1. To meet the short term credit requirements for cultivation of crops
  2. Post-harvest expenses
  3. Produce Marketing loan
  4. Consumption requirement of farmer household
  5. Working capital for maintenance of farm assets and activities allied to agriculture, like dairy animals, inland fishery, etc.
  6. Investment credit requirement for agriculture and allied activities like pump sets, sprayers, dairy animals, etc.
4. The benefits of interest subvention will also be available to small and marginal farmers having Kisan Credit Card for a further period of up to six months post harvest on the same rate as available to crop loan against negotiable warehouse receipt for keeping their produce in warehouses.
5. Banks may give adequate publicity to the above scheme so that the farmers can avail the benefits.
6. It is also advised as under:-
i) Claims in respect of 2 % interest subvention and 3 % additional interest subvention may be submitted in Formats I and II (enclosed herewith) respectively to the Chief General Manager, Rural Planning and Credit Department, Reserve Bank of India, Central Office, Shahid Bhagat Singh Road, Fort, Mumbai - 400001.
ii) In respect of 2 % interest subvention, banks are required to submit their claims on a half-yearly basis as at September 30, 2013 and March 31, 2014, of which, the latter needs to be accompanied by a Statutory Auditor's certificate certifying the claims for subvention for the entire year ended March 31, 2014 as true and correct. Any remaining claim pertaining to the disbursements made during the year 2013-14 and not included in the claim for March 31, 2014, may be consolidated separately and marked as an 'Additional Claim' and submitted duly audited by Statutory Auditors certifying the correctness.
iii) In respect of the 3% additional subvention, banks may submit their one-time consolidated claims pertaining to the disbursements made during the entire year 2013-14 latest by April 30, 2015, duly audited by Statutory Auditors certifying the correctness.

ALL INDIA BANK STRIKE ON 18TH DECEMBER 2013

STRIKE PREPONED –

ALL INDIA BANK STRIKE ON 18TH DECEMBER 2013

The representatives of Constituent Unions, after due consideration of the request of the comrades of certain States for change in date of strike since 19th December 2013 is a declared holiday for their State(s), hence decided to prepone the All India Bank Strike to 18th December 2013.

Accordingly, it has now been decided to have All India Bank Strike on 18th December 2013.

Members are aware of the decision of UFBU to call for One Day Strike demanding

• IMMEDIATE WAGE REVISION
• TO STOP BANKING REFORMS

WHY DEMAND FOR IMMEDIATE WAGE REVISION?
Wages and service conditions in the banking sector are governed by the industry-level bipartite settlements signed between the Indian Banks Association and the trade unions of bank employees and officers. Public Sector Banks, Private Sector Banks and Foreign Banks who give their mandate to the Indian Banks Association are party to the Settlements and hence are covered by the same.
The last Bipartite Settlement on revision of wages and service conditions, otherwise known as 9th Bipartite Settlement, was signed on 27-4-2010 covering the period from 1-11-2007 to 31-10-2012. Hence the 9th Bipartite Settlement came to an end on 31-10-2012. Consequently, revision of wages and other service conditions have become due as from 1-11-2012.

In view of this, as per the decision of the United Forum of Banks Unions, common set of demands for the employees and officers was submitted to the Indian Banks Association on 30-10-2012.
UFBU has been requested the IBA to adopt a time-bound programme to hold the negotiations on the demands and to expedite the Settlement as early as possible.

Even though the formal negotiations started in February, 2013, only 5 rounds of discussions have taken so far viz. on 22-2-2013, 22-4-2013, 7-6-2013, 12-8-2013 and 12-10-2013 i.e. one round of discussion once in two months.

WHY ARE WE AGAINST BANKING SECTOR REFORMS?
Banks in India today have nearly Rs.75 Lacs crores as Deposits representing the hard-earned savings of the people of the country. Hence banking institutions have to be properly regulated. It is because of these defined regulations and predominantly being under public sector, that our Banking system was saved from the global crisis. Because of de-regulation and liberal banking policies, many Banks in many countries including in USA and Europe have collapsed. Indian banks were saved because of our strong regulations and being in public sector.

But in the name of Banking Sector Reforms, the Government is taking various steps and measures to liberalise and de-regulate the banking sector.

Recently, the RBI has announced in its discussion paper that the Government’s Equity capital in the Banks can be reduced to less than 51% which means nothing but privatisation of our public sector banks.

The Discussion Paper also proposes that the Banks may resort to merger of Banks to become international Banks. Our Banks are meant for our own economic development and hence this is clearly unwarranted. Further merger has its own adverse implications to the detriment of the employees and officers working in the Banks.
RBI has also issued recent guidelines by which it is proposed to give the Foreign Banks, near national status and even a scope to take over our domestic Banks. Already, the foreign capital and investments in our Banks have been increasing and now the move is to allow the foreign banks to take over our Banks.

In the name of Reforms, the Banks are also outsourcing the regular jobs in the Banks on contract basis thus increasing the risks involved. The problems faced in the ATMs on account of outsourcing are there for everyone to see. The Notice of Strike has already been issued today by UFBU and the details of Agitation Programmes are as under:
